EU International Insolvency Law and Third Countries: Which Way(s) Forward?

About the project

The project was initiated in 2022 by professors Alexander Trunk (Kiel University) and Jasnica Garašić (Zagreb University) and is planned for a duration of two years. It brings together renowned scholars and legal practitioners from all over the world for research on how legal regulation might be improved as to cooperation between the EU and non-EU countries in insolvency matters.

The present EU Insolvency Regulation does not deal with third country relations in a structured manner, leaving many questions to the divergent laws of EU Member States. The consequence of this are uncertainties e.g. with regard to restructuring of globally acting companies. The purpose of our project is to conduct a joint research on how to improve this situation and, if possible, to develop some legislative suggestions for policy-makers in the EU or in other fora, e.g. UNCITRAL.

The project has received support from UNCITRAL and cooperates with the European Commission and the Hague Conference on Private International Law. It has received financial support from Thyssen Foundation (Germany).

Also, the project has been presented in several international fora, e.g. at the Academic Forum of the INSOL International London Conference in 2022 and at the Panel discussion on sharing experience across regions (15 July 2022) on the occasion of the 25th Anniversary of the UNCITRAL Model Law on Cross-Border Insolvency (1997).

Until the 2nd Project Conference, new participants may join the project upon agreement with the coordinators. Thereafter, the written contributions will be prepared for publication, which is planned in 2024.
