International Insolvency Project

EU International Insolvency Law and Third-Countries: Which Way(s) Ahead?

A policy oriented project

The project, administered by the Institute of East European Law of Kiel University, and supported by UNCITRAL and the Hague Conference on Private International Law, aims at developing recommendations to the relevant bodies (the EU Commission, UNCITRAL) on the future regulation of relationships between the EU and Third-Countries in the field of cross-border insolvency.

More than 30 prominent scholars, judges and practitioners all over the world participate in the research. The project is carried through in constant contact with the competent officers of the European Commission and UNCITRAL.

From 26 to 28 October 2023 a second project Conference will take place in Kiel (and online) in which sent-in papers will be discussed and possible recommendations should be developed. On 26 October 2023, before the start of the Conference, a Young Researchers Forum on the project will be held.

Survey

A key feature of the project is the empirical assessment of the dimension and relevance of insolvency proceedings regarding EU and non EU jurisdictions.

This assessment is done through a brief questionnaire, which practitioners, judges and scholars are invited to answer. The results to the survey will be presented during the 2nd Project Conference.

If you have experience with cross-border insolvency, you can share it by answering the questionnaire (it will not take more than coffee break time!).
